Quentin secures acquittal for Accountant in Driving allegations

Quentin represented Miss ND, a chartered accountant who faced an allegation of Careless Driving and failure to stop at the scene of an accident. ND was alleged to have been involved in a collision with a stationary vehicle and made off without stopping in central London; this allegation was supported by a statement from an ‘independent’ witness. ND’s case was that she was never involved in an accident and that she was being set up as part of a fraudulent insurance claim.

Upon being instructed Quentin set about collecting evidence for a formidable defence in NG’s case. He collected photographic evidence from the local council’s parking ticket database showing the pre-existing damage to NG’s car and instructed a road collision expert witness to demonstrate that the damage upon the two vehicles was not consistent. He also collected evidence from NG’s insurance company showing the hyper inflated nature of the insurance claim. Despite presenting this evidence to the CPS they chose to continue with the case. So Quentin obtained bad character material showing that the alleged ‘victim’ of the hit and run was previously convicted of dishonesty matters and had been part of a London Gang.

At trial Quentin aggressively cross examined the prosecution witnesses in the case and demonstrated the deficiencies in the prosecution case. This was so effective that the Judge in the case stopped the case before either the defendant or expert were due to give evidence due to unreliability of the prosecution witnesses. The Court therefore entered a Not Guilty verdict to all counts and ordered costs in the defendant’s favour.
